Septic Tank Company Sued for Same-Sex Sexual Harassment and Retaliation

Shelley’s Septic Tank Inc, operated out of Orlando, settled a lawsuit by agreeing to pay $82,500 and provide other necessary relief to end same-sex sexual harassment and reprisal.

As per the press release, the U.S. Equal Employment Opportunity Commission (EEOC) has sued the male owner of Shelley’s Septic Tank for sexual harassment.

The lawsuit alleged the male owner continually made sexually charged remarks to a male employee and engaged in unsolicited physical contact despite his objections.

Subsequently, the employee reported the sexual behavior to the Sheriff’s office. After being informed of the reported allegations by the Sheriff’s office, the company owner retaliated by terminating the employee on the first day he reported for work after making the complaint.

The company violated federal law which forbids sexual harassment and reprisal against employees for objecting to such discrimination.

Accordingly, the company will pay $82,500 as a settlement and create a written policy against discrimination. Furthermore, Shelley’s Septic is required to conduct anti-harassment and discrimination training.

In addition to submitting written reports to the EEOC twice a year, the company must publish a notice at its site regarding the lawsuit.

The Director of the EEOC Miami District Office stated the verdict conveys a powerful message to the businesses and their owners. He further emphasized that failing to and address sexual harassment against employees results in severe consequences, especially when committed by management.
